1. Service Description
ADA Proof provides automated website accessibility scanning tools. Our service checks web pages against WCAG 2.1 Level AA guidelines and provides reports identifying potential accessibility issues.
We offer two tiers: a free single-page scan available to anyone, and a paid subscription ($29/month) that includes full-site scanning with weekly automated monitoring.
2. Not Legal Advice
ADA Proof is an automated scanning tool, not legal counsel. Our scan results should not be relied upon as legal compliance certification. The results are technical findings that may help identify potential issues, but they do not constitute legal advice about ADA, WCAG, Section 508, or any other accessibility standard or law.
You should consult with qualified accessibility professionals and legal counsel to determine your specific compliance obligations and to address any accessibility issues.
3. Limitations of Automated Scanning
Automated accessibility testing has inherent limitations:
- Automated tools can identify many common accessibility issues, but cannot catch all types of barriers. Industry estimates suggest automated testing detects approximately 30-40% of accessibility issues.
- Some WCAG criteria require human judgment (color contrast perception, cognitive accessibility, content appropriateness, etc.)
- Results are point-in-time snapshots. Your website's accessibility status changes with each content update, code change, or third-party script modification.
- Our scans check publicly accessible pages. Content behind logins, dynamic content loaded via JavaScript, or pages excluded by robots.txt may not be scanned.
We strongly recommend supplementing automated scanning with manual testing by accessibility professionals and testing with users who have disabilities.
4. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
ADA Proof and its operators shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from:
- Reliance on scan results for compliance determinations
- Accessibility issues not detected by our automated scanning
- Legal claims, lawsuits, or regulatory actions related to website accessibility
- Business losses, reputation damage, or settlement costs
- Any decisions made based on our reports
Our total liability for any claim related to the service shall not exceed the amount you paid for the service in the twelve months preceding the claim.
5. Indemnification
You agree to indemnify, defend, and hold harmless ADA Proof and its operators from any claims, damages, losses, or expenses (including reasonable legal fees) arising from:
- Your use of our scanning service
- Your reliance on scan results
- Any accessibility claims against your website
- Your violation of these Terms
6. Accuracy Disclaimer
We strive for accuracy in our scanning tools, but we make no warranty that our results are complete, accurate, or current. Accessibility standards are complex and subject to interpretation.
ADA Proof is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
7. Subscription Terms
Paid subscriptions are billed monthly at $29/month. You may cancel at any time through your account settings or our payment provider (Polar.sh).
Upon cancellation, you retain access until the end of your billing period. Scan history expires naturally over 30 days after the scan date, regardless of subscription status.
We may modify subscription pricing with 30 days notice. Continued use after a price change constitutes acceptance.
8. Acceptable Use
You agree not to:
- Use our service to scan websites you do not own or have authorization to scan
- Attempt to circumvent usage limits or abuse the service
- Resell or redistribute scan results commercially without permission
- Interfere with the operation of our service
9. Changes to Service
We may modify, suspend, or discontinue any aspect of the service at any time. We will provide reasonable notice for material changes when possible.
10. Governing Law
These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict of law principles.
